Judge Charles Breyer’s Shocking Move Stuns Nation
A federal judge appointed by President Bill Clinton, Judge Charles Breyer, has ordered former President Donald Trump to return control of the California National Guard to Governor Gavin Newsom. The ruling, which was issued on Thursday, stated that Trump had unlawfully federalized thousands of California National Guard members.
Breyer noted that Trump failed to meet legal requirements for federalizing state troops and violated federal law by not issuing orders through the governor. Newsom confirmed the National Guard would return under his authority by noon the next day, with troops resuming critical duties such as border security, fentanyl interdiction, and wildfire prevention.
In response to the ruling, Trump thanked the federal appeals court for temporarily pausing the decision. On Truth Social, he claimed that federalizing the National Guard had saved Los Angeles from potential destruction, referring to the unrest in the city. Judge Breyer also rejected Trump’s justification for federalizing the troops under the premise of suppressing a “rebellion,” stating that the protests in Los Angeles did not meet the legal threshold for such action.
The judge emphasized that the protests, related to immigration raids, did not constitute a rebellion or violate the 10th Amendment, which protects states’ rights. The Ninth Circuit Court of Appeals has paused Breyer’s order while a hearing is scheduled for Tuesday to further address the issue.
