A federal judge has ordered former President Donald Trump to return control of California’s National Guard to the state. Judge Charles Breyer ruled that Trump unlawfully federalized thousands of guard members.

The ruling was a significant victory for California’s Democratic Governor, Gavin Newsom. He had sued the Trump administration after the guard was called into federal service during protests related to immigration policies.

Governor Newsom stated that, under the order, control of the troops would be returned to him. He announced the guard would resume its state duties, including border security, fentanyl interdiction, and wildfire prevention.

However, this transfer of authority has been temporarily paused. A federal appeals court issued a stay, halting the judge’s order just before it was set to take effect.

In his 36-page ruling, Judge Breyer stated Trump’s actions exceeded his statutory authority and violated the Tenth Amendment. He also noted the administration failed to issue the federalization order through the governor, as required by law.

The legal battle is ongoing. A panel of judges from the 9th Circuit Court of Appeals will hold a hearing on the case to further consider the arguments.

This case highlights the ongoing tensions between state and federal authority. The outcome will determine who controls the California National Guard while the appeals process continues.
